Methods and Techniques | Derste karma yöntem kullanılacaktır. Konu bütünlüğü ve öğrencilerin derse hazırlanmalarını sağlamak maksadıyla önce eğitici tarafından İdarenin sorumluluğu konusunda genel bilgilendirme yapılacaktır. Öğrenciler ise ilk haftadan itibaren verilen/seçilen belirli konular üzerinde araştırma yapacak, bu araştırmaların ilk ve özet ürünlerini makale taslağı/bildiri şeklinde belli günlerde sunacaktır. Her konu eğitici gözetiminde öğrenciler tarafından tartışılacaktır. Sunulan bu makale taslakları yeni araştırmalar ile yapılan katkılar ve eleştiriler çerçevesinde genişletilecek ve dönem sonunda değerlendirilmek üzere eğiticiye teslim edilecektir. Ders esnasında öğrencilerin aktif katılımı esastır. Öğrenci belli bir konuyu araştırıp metin haline getirmek suretiyle makale ve tez yazma konusunda belli bir alt yapı edinmiş ve çalışma deneyimi kazanmış olacaktır. Öğrencinin sunum ödevi ara sınav olarak değerlendirilecek, makale çalışması olarak final sınavının ağırlıklı kısmını oluşturacaktır. Final sınavı ayrıca aktarılan ve çalışılan konuların yazılı olarak ölçümü şeklinde olacaktır. |

Course Content
Dersin konusu GENEL OLARAK Türkiye idaresinin işlem ve eylemlerinden dolayı sorumluluğunu içermektedir. ÖZELDE ise alt konu olarak; - idari sorumluğun tanım, özellikleri, türleri, - kusur ve kusursuz sorumluluk türlerine ilişkin ilke ve esaslar, - - bu sorumluluk bağlamında Türk hukukundaki yaptırım ve giderim yolu olarak tam yargı davaları ile -Maddi ve Manevi Tazminatın tanımı, türleri, usul ve esaslarının yanı sıra - Tazminat hesaplama ilkeleri, şekli ve usulü konularını kapsamakta ve içermektedir. Ayrıca bu derste spesifik olarak idarenin depremin ve deprem dışındaki (sel, heyelan, çığ vb.) doğal afetlerden, terör eylemlerinden, sağlık hizmetlerinden, imar faaliyetlerinden ve idari işlemlerden doğan zararlardan dolayı sorumluluğu konuları tartışılmaktadır.
Objectives of the Course
To explain the sources, procedures and principles of the administration's legal responsibility for the damages caused to individuals and communities through its activities; The aim is to explain full jurisdiction cases by taking judicial sanction regarding this responsibility. The aim of the course is to provide students with theoretical knowledge about the responsibility of the administration as well as judicial practice through jurisprudence.
