Course Content
Strict responsibility concept. Strict liability basis. Basis of Equity. The Basis of Objective Care. Danger Basis. Abnormal basis. The principle of balancing of sacrifices. Examining the principles of strict liability and technical connections with the elements of tortious act. Examining the cases of strict liability in Turkish Law of Obligations separately.
Objectives of the Course
Introducing the concept of strict liability. The exceptional nature of strict liability and its consequences. Explaining the principles on which the cases of strict liability are based and establishing their connection with the elements of the tortious act. Technical examination of the characteristic structures of each strict liability type by examining the cases of strict liability separately.
