Course Content
Tort from the sources of debts. The place of tort in different legal systems. Tort in Turkish Law of Obligations. Elements of tort. behavior concept. Theories about the concept of behavior. The causal link concept and related theories and especially the appropriate causal link theory. Harm Concept. The issue of attributability of harm to the perpetrator and its technical examination. The concept of unlawfullness. Theories of unlawfullness of behavior and outcome. objective and subjective theories of unlawfullness. The third theory of unlawfullness. Fault concept. objective and subjective theory of fault. Examining the mixing and separation of the concepts of fault, causation and unlawfullness.
Objectives of the Course
Liability arising from torts, which are the sources of debts, will be examined. In this context, the nature and characteristics of the tort, the elements of the tort and the theoretical views about them will be analyzed and revealed. Understanding the extremely complex theoretical structure of tort liability is one of the main objectives of the course. For this, it is aimed to teach the connection of the elements of the tortious act with each other and the technique of establishing responsibility.
